I am OPT holder, unemployed, just married to a US citizen but have not applied for my green card. I have to go home in a month and would like to stay there for a few months due to family issues back home. I would like to know what visa I need to apply to come back to US? If I file all my documents now, is it possible to get travel document in mid Jan?
Thank you for you help in advance!

Hi Triple Citizen,
Thank you for you reply. If this case, I have decided to leave US without applying for green card. So my husband will have to apply for k4 visa for me to get back to US. I would like to know how long does the process take to have k4? Should I go to the immigration medical exam before I leave US? I am thinking to come back in 6-8months. When should we file I-130, I-485, I-131, I-765 and G-325A, I-693 all these documents (when I am back home or after I come to US with K4?) Ideally i would like file these now when i am still in US, but I have to leave in Jan and therefore might not be there when i am needed to take biometrics and attend interview stuff like that.

Any thought on my situation will be great! I still thinking for the best solution. We are just worried that I might not enter US again. Thank you!

It took me about 50 days to get my AP. Extended travel abroad with the AP is not advisable. If you can stay here around 4-5 months, if you apply for AOS, it should come through (provided you guys have no other issues).

wow! 6-8 months to get k3 and after that i still have to wait for another 90 days to get my EAD card and work??!!!
Do you recommend me to do immigration medical examination before i leave US in Jan? or just do it back home in m'sia?

thank you in advance

K3 processing time varies by country and consulate. Contact the US consulate in your country to find out. In places where the K3 takes 6-8 months, it probably would be better to directly apply for an immigrant visa via consular processing. That way you'd instantly become a permanent resident upon being admitted to the US with the immigrant visa, instead of having to file I-485 and the other paperwork and wait some more months.
