Hello everyone, now that we're married :D and have not as yet began AOS procedures, still on the HM  , DH who is USC will be filing taxes soon and wants to file as 'married filing jointly' but I do not have any US ID. Do I apply for a ssn one that permits me to transact business but not work, or is there another procedure? Thanks in advance.

Hello Conqueror

A friend of my husband filed "married filling jointly" using a W-7 form which u can get from your tax ppl.......this form is used to apply for an individaul taxpayer indentification number (ITIN) similar to a SSN but the individual can only use this number to file taxes....it cannot be used for employment........u could probably look up on the WWW.IRS.com website and read more on it.......I'm not too sure if it would apply to u.......Hope this helps.....

I don't know if you can do that? what year did you get married? I got married last month but we still had to file taxes separate since we weren't married on 2005. I did mine online and it said that you're considered married for tax pursposes if you got married during that year, meaning 2005 in this case. For the SSN, I don't know if u'll be able to get it without a job and without any AOS paperwork going. They just don't give away ssn to anyone, you need to have a valid reason to why you need one.

I just went to the local IRS office the other day, being in the same boat as you. My wife is USC and we married last year. So we file 1044 jointly, me being unemployed since I'm still waiting for EAD.
I had to file W-7, attached copies of my german passport and a letter from SSA saying they can't give me a SSN because my status is not clear. I had to cosign the 1044 and that was it.

Conqueror, you got married when? in 2005 or 2006?

Check with your IRS office. There is a part in the IRS that explains how to file when one person is not resident during the tax year.
