Dear Friends,
I want to inform you a very happy and indeed a lucky case. Though I never visited this forum, before submitting my applications, I learnt a lot here afterwords. I have refereed this site to lots of my friends.
My Credentials: Research scientist in a university (very close to hurricane affected gulf coast) in the field of nanoscience. More than 10 years of research experience. Ph.D. from a reputed national lab. in India. Postdoc, visiting scientist in Europe, Australia, USA, South America. More than 50 publications in international journals, more than 100 citations, 30 presentations, Referee for 5 journals. Two National Awards, membership in International academic societies.
Time line:
9/16/2005: Lawyer called and explained me about VISA number, retrogression for India in EB1. I never knew about the VISA number for green card ! I was really kicking myself in the back for waiting so long to apply ( I could have applied at least a year ago). Lawyer gives me about 7 days to arrange everything (copies of the paper, reco, summary of research etc., medical clearance, birth certificates from India etc.)
9/30/2005: Complete application package EB1-OR (I-140, 485 etc. for me and spouse) reached Texas Service Center. The lawyer wrote a very short but precise cover letter, based on my itemized CV and 3 recommendation letters (only pdf files received via email)! Luckily I had copies of all my publications (really added the weight of the package). In between I had lost all the communication line for 4-5 days due to hurricane Rita !
10/18/2005: I-140 approval message! I could not believe it, as I was desperately praying at least for a RFE !
10/25/2005: EAD and AP approved.
11/15/2005: RFE for medical exams. (Desi doctor in the panel forgot to sign in the medical form !)
3/15/2006: Code-3 biometrics.
6/5/2006: I-485 approval messages
6/12/2006: Green card for self and spouse arrived home.

Summary: Luck favors brave, hardworking and "most impotant" helpful people. Retrogression in EB1 for India is very much an artificial one, but probably it was done to help people struck in FBI name check ! THANK YOU ALL IN THE FORUM (particularly eb1doc and others). Keep helping others, your luck will favor you at least once!
 
when do you think will be good times for EB2 NIW approvals. Its like I've been waiting forever and it has become like a habit for me now to check my status, this portel and a few other web sites. It is now about 60 days after I sent the RFE

Congrats EB1-just-lucky!! your dates are very similar to mine. I-140 & I-485 RD was Sept. 30 and I-140 AD was Oct 19th. Did my code 3 biometrics on Dec. 14th. Only difference is my case was EB1-EA.

Hi SumeetBabu,
I guess EB2-NIW (India) will have to wait for a while. Why not try EB1-OR or EB1-EA ? Recently there is a nice posting in immigration-law.com, citing USCIS clarification on permanent job requirements for EB1-OR ! In my experience preparing NIW is more harder than OR.

Hi Raj97: I was expecting your's to get approved much before me as you had code-3 in December.
 
EB1-OR cannot be self petitioned is this correct?
What about EB1-EA ?

If yes what is basically needed ?

Any body have approved EB1-EA (my univ will not petition for OR unless I am tenured :mad: :mad: ) willing to share data will be very helpful. My NIW at NSC is still pending and in the meanwhile I am contemplating EB1-EA as suggested.

Yes you can self-petition EB1-EA...see my credentials below (i didn't even go through lawyer....did everything myself): You need a very strong cover letter in which you will mention about your achievements and projects you are working on...

1. I have done my Ph.D. from India and working currently as a research scientist.
2. Got a fellowship during my Ph.D.
3. Got 2 Research Supplement Awards during my Postdoctorate
4. Got an Award for inventing an enzyme assay kit
5. Patented one enzyme assay kit
6. Reviewer of 6 different Journals
7. Membership of 2 Scientific Associations
8. 4 first authored papers
9. 9 second or third authored papers
10. 2 book chapters
11. 11 abstracts
12. 5 posters
13. 2 oral presentations
14. 4 conferences attended in US and 2 in India
15. Some of our work was cited by many online newspapers
16. Around 40 citations of my papers
17. 8 strong recommendation letters from India, Italy, Canada and US
18. 4 letters from the undergraduate students and fellows whom I helped in their projects.
19. 5 years of research experience in US.

I think you must give it a shot. You have very good chances. See if you can get membership in some scientific associations (there are many associations where you pay some fee and become members). That will add to your credentials. There are also many online journals where you can fill the forms to become reviewer for their journals in your field. It takes some time till you actually get any papers from them. What I suggest is that when you opt your field of expertise in those forms, try to opt for broader research area. In that way you will have a better chance of getting any offer to review a paper.

I am still contemplating EB1-EA.
I will see what I can come up with, Can I use the same letters that I used for NIW basically they talk about the same thing.
Any suggestions?

I wish your good news is coming... So now you should give a try for EB-1A. I have seen people getting approved with just 6 publications. It all depends how great is your cover letter. ... Good luck

My field is Cancer biology (Brain basically) any suggestions which journals I could target

I would suggest you to do a search in PubMed Journals database and look for the journal of your interest. Once you find a journal, go to its website (home page) and see if they have any instruction for becoming a reviewer (usually you have to sign in to become a member). Copy this link below to go to the pubmed journal database directly
