Hello Everybody!! :D
I just got married :) and trying to submit all my paperwork. And I have a lot of questions!!!
I have been in United States for 2,5 years. I got here on J-1 work and travel program, then adjusted my status to j-1 Trainee (I don't belong to the group of people which have to leave the country) and now I am on tourist visa which is going to expire in a month. Only first 3 months of my being here I worked with work authorization. The rest of the time I have been working without it, just giving my employers my SSN (they never ask for any work authorization papers here, in SC)
And looking at all these forms I get confused.
Here are my questions:

1. I-130. question # 15. Name and address of present employer(if any)
I am working, even if I am not supposed to. What do I have to write?? the Truth?? Or just Put N/A???

2.I ve been married before, I got divorced in Russia several years ago. The only divorce notice I have is in my Russian passport. Marriage seal , and divorce seal. Is it going to be enough???

3.I would like to go home next summer. I was wondering if I still can do that ( I have been working without any permission plus I am going to be out status in a month) Is the any sense do apply for i-131????

4. DO I have to send the whole packet of documents to Immigration Services at once???? Or there is a sence to hold on some of them??

5. G-325a. Applican's employment for the last five years.
I am not going to be deported if I tell the Truth , right???

You will make me happy if you help me with you answers.
Thanks a lot

Merry Christmas and Happy New Year!!!!

The truth. I was out of status but my lawyer still wanted me to put my work

Should be enough

3.I would like to go home next summer. I was wondering if I still can do that ( I have been working without any permission plus I am going to be out status in a month) Is the any sense do apply for i-131????
Nope, don't waste your money applying i131. Are you marrying USC? If yes, the process should be faster than marrying GC holder

4. DO I have to send the whole packet of documents to Immigration Services at once???? Or there is a sence to hold on some of them??
Yes, you need to send the whole complete docs otherwise you will get RFE taht could delay your processing

5. G-325a. Applican's employment for the last five years.
I am not going to be deported if I tell the Truth , right???
Yes, you're not if you're marrying USC. It's forgiven

Privet Darena!

I put N/A when answering about my work in US. (I am in the same situation)
Well, it ,of cause ,won't be a problem for you if you put the name and the address of your employer (you are forgiven as a spouse of USC) but it can create a problem for your employer. IF you are fine with this ,go ahead...

But in the case that the officer ask about it and they found out then she will be in trouble because is a lie, remember that you will be under oath and when you sign the papers is the same thing. Is better to say the truth, anyway your work without authorization is forgiven.

About your divorce, you need to get your divorce decree or a document from a court or a higher level from Russia that states when, to whom and date of your divorce and translated it.

If you want to go outside the US next summer, since the timeline varies from DO to DO (district offices) you can file for AP (I-131) to be sure that you will be able to travel if you still don't get your interview and a result for your I-485, remember to read the warning at the form if you going to be out of status more than 180 days.

Deported? Well, marrying a USC is not a guaranty that you won't get deported from other circumstances. But as far of your case goes there is nothing you should worry about if your marriage is bona fide and you don't get involve in any crime :).

Good luck,
