Just got e-mail from USCIS

I've got a RFE for I-485.
Is this thing supposed to be mailed to me or my lawyer ?
Ironically, I am moving today. I setup mail routing at my post office, but I just need to make sure I don't miss this thing. I have heard horrible stories about people getting process denied due to a silly address change.

My wife got an RFE last year and it went straight to the lawyer. I did not even see it. I am sure thats whats going to happen in your case. Make sure to let your lawyer know that you got the RFE email and ask them to look out for it. I am not sure how prompt or responsible your lawyer is but as the applicant you will need to stay on top of this and make sure that the lawyer responds within 120 days. You will receive an email acknowledgement once the the RFE response is received by the USCIS.

My lawyer takes forever to answer. The typical immigration attorney I guess.

Considering the fact that they are obviously working your case, this may be a good sign of pre-adjudication before an approval.... what I'm saying is that maybe priority dates will move enough in the near future and they are getting ready to approve you!
 
Time to badger your lawyer

If I were you I would use all avenues open to me.

I would let the lawyer know. Call their office every week until they acknowledge recieveing and replying to the RFE.

I would leave the forwarding address with the USPS AND intermittently check with the previous address.

I would also keep to answering the USCIS within 30 days if you have no answers.

Do it all my friend, since you ought to trust noone until your response is seen at the USCIS. Lawyers are less than perfect and sadly if they screw up you have limited recourse also.
 
Initially I thought about it, but it seems that folks from PD 2003 are getting RFE's as well. It is strange. Someday I guess this process will have to finish.

My friend's wife got an RFE email on June 19th and she is the dependent. The primary has already been approved..

Her lawyer has yet to get the mail.
the questions are:

1) How long do you get to reply to the RFE ( assuming it is Biometrics/Meds etc..)
2) Is it ok if you go to their local office to get the RFE or know its contents before 30 days..
3) what do you do to get the mail quickly?

Guys and Gals,

If NSC is issuing RFEs on 2003 cases then this clearly shows that they have very few cases from 2001. These PD dates are way behind where they should be. If USCIS was truly swamped with 2001 cases then would they have the time to look at 2003 retrgoressed cases? I THINK NOT ...

Answer - I believe you have 120 days but its best to do it ASAP.

2) Is it ok if you go to their local office to get the RFE or know its contents before 30 days..

Answer - The RFE is mailed out by USCIS and your lawyer will receive it. You will not.

3) what do you do to get the mail quickly?

Answer - You can do nothing. If two weeks pass and your lawyer does not receive the RFE, then its time to hound the USCIS.

My PD is Nov. 2001 and was issued RFE on Jun 14th. Still don't know what it is as the lawyer has not contacted me. I still won't read much in to these actions. It's good to see that the file is actively being worked on. I wish I could believe that USCIS has picked out AoS files that could be approved in FY 2007 and is working on them but I believe it's still arbitrary.

Where this 245(i) cases are being processed. Yesterday I read somewhere (WSJ article on Dr.Sengupta ???) that there are about 185,000 cases pending in the BECs. Does this number include both regular filers and 245(i) cases ?

I believe its a total number. Also a lot of the regular filers (non-245is) stuck in BEC have now opted for PERM.

As for 245is being stuck in the BECs. Whats the point of waiting on these cases and holding all the dates back?

You see, only now they have been able to work on let's say, 2002 cases for sure.


I don't know, the idea of holding up priority dates so agressively just "waiting for cases" never cut it for me. All the way I thought that a major reason to retrogress cut-off dates was the idea that USCIS has huge backlogs and needed to work hard to eliminate them. Retrogressing the dates was a way to create an artificial sensation that they have achieved 6 months processing goal.

If that theory makes sense, we may see dates advancing to mid 2002 in the few months ahead. Just watch. I promise I will not expect for that though, because no one can predict what's going on with USCIS.

The point is to prevent further retrogression may be. Remember how USCIS gave out visa #s in 2004 regardless of priority dates. I think they want to avoid that kind of scenario and when they say pd of APR 22 2001 that means all the cases before the PD is flushed out of the system. My hunch.
 
If they are working on those cases, aren't they able to simply read the the date of the application, on the top of the application form, and simply put them on sequential order in the computer ?!

We will know shortly. Since now we know for sure that they are working on these, let's see what happens to the visa bulletins from now on.

The problem is

Labor clearance is done by DoL. I140 and 485 are with USCIS. So USCIS doesn't know who many Labors are still pending from 2001/2002. Once the labor is cleared, the applicants have to file I140 and I485. Some do quickly some take their own time. Not to mention medicals etc. So the system is setup in a way that FIFO is impossible to implement but everyone including applicants want to see FIFO in processing.
