Yes. Certainly. DOS want to limit the EB2 for India, though overall demand is less in EB2. This is because, still they moved 6 months for china and they are keeping the rest of the world current. It clearly tells there are lot of visas available, and only India is having heavy demand. DOS do not want to give more visas to Indians. The lucky guys are Chinese..

In the end, Chinese will get more visa and Indians will get less, though India has more demand than China. Once 7% limit crossed for each country in EB2, it is upto the DOS's monopoly power to allocate more or less visas to oversubscribed countries. No one can question them.

In last year, India consumed about 17,000 (38%) EB2 visas from the total of 44,000 issed. However China has consumed 10,000 (24%). All other contries consumed 17,000 (38%) visas. It is important to note that, in last year, there were no retrogressin in EB2 for India, China and all other countries.

This year this equation is going to change drastically against India.

EB-2 ... lot of guys got the preApproved labor... in EB-2 India category. Many guys who otherwise would have not qualified for EB-2 .. did squeeze in with some experience ... [EB-2 preApproved filling was hot just months before the retro hit ... some attorneys worked without much sleep -- they did manage to push in thousands of applications.]

EB-2 might not move ... or have much slower movement ... I think both EB-2 and EB-3 will show some retrogression come NOV.

Bear in mind that there were a lot of concurrent filings in the month of August & Sept 05, combined with immense EB2 filings from sept 02 to Jan 03. May be the visa numbers are available but the no. of cases are immense, hence the stop in dates for eb2. my only concern is that high # of cases from this period will send india into severe retro till next period. I seriously doubt if the eb2 dates will move at all till next visa release. this sucks 'cause i was going to be current in june.
 
Instead of putting an end to sub labor, why they accept sub labor and then logjam the categories.

If this logjam starts, then it is difficult to put an end to it.

How do you know about many EB-2 filings between Sep '02 and Jan '03 from Indian applicants?

dude last year this and other forums were going crazy with labor certifications approvals from the backlog elim. centers specially between june and september and people were filing 140/485's like crazy. My lawyer had to hire extra staff to make the 30th septmber 140/485 concurrent filing deadlines for the retrogression cutoff date. She said many people had filed the 140/485 concurrently under eb2 specially in the month of sept 05. Combine that with increase in eb2 RIR LC filings from nov. 02 onwards. So that's why i think the the pd's will not move as fast as they were earlier..specially for eb2. On the flip side the USCIS may have looked at the large # of cases and thought it might take more than a month to approve them and hence decided to pause the eb2 dates for june. it may well turn out that uscis is able to complete the processing in time and move on further. I really hope they catch up fast since my pd is jan 20, 03 and i am very close to being current. I am not being negative but we know how unpredictable USCIS is and has been.

there might be good news for u

if you download the spreadsheets from the labor cert. web site and sort out the EB2 cases filed by indians in 02 there are about 1300 cases
out of these 500 have pd nov/dec02

so you might be right

i think at least they will advance it by 1 month

tell you what the release date will be a good indication
if they release it early then dates advance,if they release it late they pd does not advance
