In Jainsan\'s case his i140 was approved in may and AOS was filed in june. There is no time for the NVC to send packet 3. He filed AOS before NVC could even forward the case to consulate. I think the problem could be when NVC sends the file to appropriate consulate and AOS is filed after that.
It\'s just my thought and i am in this situation.
Iam hoping they will pull the copy form storage.
