In any case now you have to deal with USCIS! It will be interesting how USCIS will cope with this wild swing! I guess they will take in all the fees from everyone and then retrogress in a couple of months!

The good thing for people who were already current is that we can give some more time to USCIS to process our case without worrying about dates moving back!

Yeah lets see ... but with NSC you never know .... the last time dates were current, NSC did nothing while the other centers poured approvals out.

It is time for NSC to do the pouring for a change :D

But somehow I think all of this is to get more ppl to apply for 485 before the new fees kick in ... so that they can make money out of EAD/AP renewals.

purplehazea.. I agree with you 100%. In my case I had to wait for 20 months for the dates to be current. Instead they could have moved it periodically and processed the cases appropriately.

Now what happens to the people who have been stuck in the Backlog center?? USCIS will once again retrogress the dates in the near future and they will not be able to file their 140/485. They have been made suckers once again. My heart goes out for them for its unfair.

So USICS is saying - "Its all about money, honey" and just dipping into your wallet. That sucks major. But then who said life was fair.

At least for the cases that have become current in June they will now have extra time for processing their case.

but no one is a looser now . good for everyone who files 485 in July ... atleast they can survive on EAD & AP .. as we did

USCIS gets money ( for many more years to come) &others get EAD & AP .what a deal

What we get ... well atleast once they have so many to milk .... they might let old timers go . They know they have already sucked us dry .
 
:mad: this is too UNFAIR. With PERM where people can get approved within a few weeks, this means some people can get their greencard in a few months or less. i really hope they adjudicate the older cases first!!!!!!!!!!!!! :mad:

USCIS should (legally supposed to) adjudicate older cases first. But you may never know. My prediction about USCIS is that they are the most un-Predictable.;)
 
This is absolutely depressing.

The nsc farmers will work at snails pace and give all the visa's to the 07 & 06 cases leaving behind the 01 & 02 cases.

The tsc cowboys will use all available visa's for 07 & 06 pds
all the 01 & 02 at nsc will be left sucking their thumb when they rettrogress by 6 years in sept.

You guys should be happy or at least hopefull. I am under "other workers" category. Do you have any idea when it will move forward? I have no hope for any movement anytime soon. SUCKS!
 
Guys, if this situation is really just a way for USCIS to make more money, why didn't they wait until August to make almost all current. The new outrageous fees will start July 31. Right now, applicants still have 45 days to apply for I-485, EAC, I-131 paying the old fee. Can anyone explain this?
 
I do not understand why everybody is talking about USCIS making more money. In fact they are actually losing money with the current fee structure and that is the reason for fee increase. If it is really about money, they could have waited for another month before making dates current so that every one would file with new 'increased' fee.

If you read immigration-law.com, even USCIS is concerned about about dates being current as they have tremendous amount of workload and making it difficult to meet 6 month goal. Now it is likely that even sending receipt notices would take considerable amount of time.

Visa bulletin is released by department of state based on number of visas available and current demand. Demand means, pre-adjucated applications ready for approval and consume visa number immediately. From ombudsman 2007 annual report, it is mentioned that there are about 40K visas available and if not consumed before Oct, they are lost - unless a new rule gets into effect in future to re-capture them. That means they need to give out that many GCs in next 3 months and there might be less than 40K applicants who are ready for approval - So dates were made current.

So the big question is, why the dates were not moved gradually. From the previous bulletins, DOS expected a lot of demand from cases cleared from BECs which may have very early PDs. I assume USCIS wanted to be fair to folks with earlier PDs by making a cautious effort to approve them prior to folks who filed recently ex: perm filings and folks with later PDs approved from DBEC as compared to PBEC etc. So, they had been very conservative about cut-off date moment. But since this demand is not materialized yet (or actually less than anticipated) and now since they are running short of time, the dates have to suddenly moved and made current.

Once all these new filings start getting pre-adjucated and reach final approval stage, the cut-off dates must be retrogressed as they are determined based on 'chronological order of PDs of documentarily qualified applications'.

What ever might be reason fair or not fair, it is definitely a huge screw up from DOS/USCIS esp in terms of predicting demand. Their effort to maintain fairness made it worse and more unfair.

One consolation can be, though processing of apps are done according to 485 receipt date, GCs would be given according to PDs due to future retrogression - not all 200-300K applicants with PDs ranging from 2001 to 2007 can get GCs at the same time

This is purely an opinion based on my understanding and can always be debated or overruled.

Because... it will be too obvious that all these drama is for making (milking) more money from immigrants.

But they forgot that they are dealing with smart people (immigrants) from across the globe.
 
If USCIS wants money, they might had offered 10000 dollars for a GC... and they know this amount is still cheap for immigrants rather than this hassle....


To my knowledge they are in the same position as we are ...the issue is with the current immigration policy and policy makers, not the people who are executing the policy.., USCIS administrators are just trying to be creative which is good. Seems like some one is thinking/bending the policy.

Because in the new fee system, USCIS CANNOT make money on EAD/AP renewals.
A typical application goes thru at least 4 EAD/APs (+ those for family etc).

This is a smart move - make no mistake about it.
If I were USCIS, I would retrogress dates in Aug VB - that would force all folks to pay the "cheaper" fees (and get hit by renewal fees - which are the new fees)

It has therefore been necessary to make the Employment Third preference “Other Worker” category “Unavailable” for July, and it will remain so for the remainder of the fiscal year.

New numbers for the EB3 others will come only in the October visa bulletin -- nothing will happen in the summer. This is similar to what happened to EB3 in summer of 2005.
