I haven't been able to submit my petition cause my husband has been unemployed for the past year due to an accident that left him unable to. He got a job about a month ago through a temp agency but he doesn't meet the income requirements and since he didn't work at all the last year, he did not report taxes.

I was told I could get a joint sponsor but we haven't been able to find one up until now, however the problem is I don't know if we could use my friend as a joint sponsor due to the fact she's in the same process and currently sponsoring her husband. They already got the interview appointment for May 21st, so I don't know if that could be a problem for either of us.

I'd like your advice on this matter, as I've been trying to put everything together for about 6 months and I'm doing it all by myself with the help of all of you guys.

Your husband cannot submit form I-864 because-(1) he doesn't make required income needed for the purpose of this form; (2) there is no assurance of his job since he just got his job, while USCIS needs to know some assurance. So, he is out of the picture. He will be your primary sponsor if you are getting your green card thru him, but you would need a co-sponsor in order to get a green card.

Now, your friend could give this form to you despite of her having sponsoring her husband so long she makes enough income to sponsor you too. So, it's all about how much she is making.

However, another question has arise... so when I fill out the I-864 for the primary sponsor (my husband), should I just say he's unemployed since xx/xx/xxxx or submit a letter showing his 6 months contract with the agency?

Is there a possibility that they might frown upon because my main sponsor (my husband) is not employed/hasn't been employed for the past year and I'm using a joint sponsor?
 
No, they won't flown upon just because your husband didn't work or doesn't earn enough money being a primary sponsor or petitioner. It's not their business nor they care; rather they are there to follow the laws. And laws say that if petitioner doesn't work or doesn't earn enough then there must be a co-sponsor to overcome public charge inadmissibility ground to obtain a green card by an alien.

However, you guys be ready to answer how you guys have been supporting yourself in the absence of his work previously or now or when he makes little. One thing people don't know is that by fulfilling the requirement of I-864, whether by the petitioner or a co-sponsor is not enough; rather interviewing officer can see thru the whole picture to make a determination as to whether alien will be subject to public burden or not. But that doesn't mean petitioner must have to have a job or something. It's just officers determine the possibility of an alien to be on public help in the future in order to make a decision on a green card application.

If your husband is not working then he should put unemployed, but if he is working then he cannot write there as unemployed. He will need to explain in a letter as to why he doesn't have income tax returns along with the copy of IRS laws/publication which states about Who needs to file a Tax Returns.
