Joining on Approved Labor

Hi,

I am working in a big company from past 4.3 years and they filed labor 2 days before the perm got activated (26 Mar, 05) under NON-RIR with EB2.

I got offer from a startup and they have approved labor dated 14th Nov, 2003 with EB2. According to the lawyer, profile matched well.

Is it safe to join the company? Any known issues with 140 approvals with startups (infact it's a 4 year old company)?

Can anybody guess how long it will take to get the 14th Nov 2003 to became current priority date? I know it's a stupid question however expecting some good guess from the experts.

The question is
1) if you have all required experience and education by that PD date?
2) If the company has money/fund by that PD date? Or the previous person who named on the labor earns PWD by that PD date and later?

NOW if you are not from China or India :) Even with China or India, PD is GOLD nowadays, you must decide asap. Remember 1 year PD is not equal to 1 year wait time . It is usually longer.

Yes. I do have the experience mentioned in the Labor. However I still need to request form my previous employer. Lawyer is preparing the draft.

The company's last funding happend in mid of 2005 and they are no expecting any more funding...

I will enquiry the HR regarding the PWD of the previous employee.

I am an Indian citizen. The difference between the current priority date and the date available in labor is almost 3 years. So, do I need to expect that the startup stay alive at least 4 more years?

I think so if you want to play safe. Of course there may be another law coming out to help on retrogression, but I don't trust on that until I actually see it gets signed.
