Joining a different company after 180 days of filing I-485 and adding the spouse

All,

I have got an offer from a different company to join them after 180 days of filing my I-485. I am still single and I am planning to get married in another 3-4 months. Can I add my spouse on my new company's address under my I-485? Please keep in mind my I-140 and I-485 was under my old company's name.

Please advice.

Adding/Deleting/modifying wife has nothing to do with changing job. But you should be changing jobs only after 140 approval and 6 mo. of pending 485.

I have one more question on the same issue...

Since I am still single I can't really use my EAD. So the new company's laywer has suggested me to join them on an H1-B( they will do an H1 Transfer ) and I can bring my wife on H4. My question is that to make sure that my Green Card is continued , do they need to file my new H1 ( LCA ) under the same job position under which my Green Card Labor was approved? They will give me a letter of the same job position and salary for which my labor was approved once I get an RFE for employment verification during my 485 approval process.

H1 job description can be different from GC job description. But for convenience sake why not make it the same.
Regrading H1/H4 etc - ask a laywer.

Better let your employer/lawyer get LCA for H1B transfer with same skills on LC it will be better for you. Employer or lawyer should have no problem writing the same job title or skills as on LC.
If the employer feels uncomfortable writing same skill or job title no problem (I don’t think they should have any problem writing the same skills or job title on LCA or the supporting documents for H1 transfer), just join on H1 transfer.

--------- when you get married, bring your spouse on H4 status, file her I-485, EAD, AP, just attach copy of your I-485 filing reciept and her I-485 will be attached to your pending I-485 file, your new employer has nothing to do with your wife I-485 it belongs to her and based on your I-485. you dont have to write new company address on your wife I-485, it has to be YOUR home address on her I-485, EAD, AP
Please keep in mind my I-140 and I-485 was under my old company's name.
----- no problem, past company or new company has nothing to do with your wife I-485, it is her application. only LC and I-140 belong to employers I-485 belongs to employee or your dependents or spouse, nothing to do with employer


**** did you get I-140 approved? if I-140 is not approved till date dont change the employer becase past employer may revoke the I-140 and then you have to start GC process again

My I-140 has already been approved and its been more than 180 days since my I-485 was filed.

They are offering me $80K( gross ) of which $60K is base salary and my GC labor states $65K . Is it mandatory to have the new baic salary >=$65K to make sure I am in the preview on AC21 or the gross will suffice for the same i.e $80K. Please remember I will be getting W2 for only $60K.

Kindly clarify the same...

what is difference between

For going with a contract position, what is the difference between :

(1) Doing a Corp to Corp contract

(2) Having W-2 Contract
