Job offer while awaiting TSC I-485 AP

Folks:

I filed my I-485 to the TSC in April of 2002 and did my FP in April 2003, I am still awaiting the approval. In the meantime, I have received a job offer from a small 2-man firm with the same job description…ground floor opportunity with plenty of growth potential.

Question:

1. Is there a restriction on the size of company (number of employees, revenues) one can join in order to maintain there I-485 application? Just in case I get an RFE.

2. Can I go 1099 instead of W-2 and still not run afoul of any laws?

I’ll appreciate good advice on this matter.
 
The company size no one cares... when RFE comes the joining company support for all the documentations.

It is better go on W2, if RFE came for W2/Payslips/Valid Status
then the problem comes,

1099 means you have to run your invoice/payroll and generate all the payslips on your comapny name. It is some want risky ?

I'd say work on both the jobs if u can..

On a serious note, I'd go with Bash idea...But working on 1099 isn't such a hassle if u r organized (like all of us here!!) :)

but as he said..size doesn't matter (one of the few times!)..as long as u r in the "same-type" job..

I completely agree with BaSh on 1099 ver W2.

But I do have a concern about the Revenue of the company. I have heard that sometimes INS will ask about company's financials statements (none of my close friends experienced this though!!) and other documents to support that they are able to employ you in the future!! Isn't the size and revenue matters then??:confused:
