Job offer and EAD

Tammy,

Too late. I have already faxed them my approved LC, I140 and pending I485. And the recruiter said she had forwarded those documents to the leagal department and waiting for reply. She said that was part of the process to check my eligibility to work there.

Do you think I have messed things up?

Looking at the initial question I figured out the company is either MS or intel, looking your new job title I knew it was MS.

Anyways no need to worry. Even though you have EAD, it is better to do a H1 transfer, once you are on EAD and something happens, you cannot even go back to H1.

You did the right thing, by submitting all that stuff. Such big companies do not bother about immig costs, they just want, once you are joined them, there are no furture immigration problems. For that, even your AOS is pending and you have EAD and if H1 transfer if possible, it is the BEST option. To know why just browse aroung these forum, you will find why.........

No need to hire a lwayer and stuff, they are big companies and are not out to screw you, thay just are taking the route that is safest to you and them , i.e do a H1 transfer

I am in to my 8'th year I think on my H1B and I just got my H1B extension for that, even though I have EAD and have AOS which has gone to a deep slumber....

Hope this helps

Stinger,

I have used my EAD, so I cannot go back to be on H-1B again. Don't know if that will cause any problem.

Even then, my guess is they just want to make sure that all your immigration papers from past and for future are intact and correct and be prepared to provide any immigration help in future.

I knew someone who even though had an EAD (though never started working on it) took all those papers from past and did a H1 transfer becuase he was eligible for that.

No nothing. If they ask you any thing. Tell them you are eligible to work. If they do not agree or any thing ask them to confirm with their attorney.
By the way as some mentioned above H1 is more safer.

Thanks for all your support and help.

I sent the recuiter the I-9 print out with the explanation of employment authorization requirements, and she finally backed down and said I could start immediately.

The legal department said the same thing and agreed to prepare the document for my I-485 portability.

All is good now finally.

Stinger and Tammy2,

Do you guys know if MSFT provide employment verification letter to INS to invoke AC21?

Thanks,

It's not with MSFT or anything, they will provide EVL like any others.
Decide whether you want to send AC21 letter to INS now or just before your I-485 interview/approval.

It does not do any harm to let them know, that you will need a EVL for immig purposes. They will be doing the same for scores of employees on need basis.

I am debating about it right now. Are there any disadvantage by sending in AC21 letter now?

Also, the attorney at the company wants to take over the process and file EAD for me. I am a little uncomfortable to let them do that. I guess I am a control freek.
