Job interview for AC21

For those who is using AC21:

Case 1:
Suppose you change job from Company A to Company B and you want to use AC21 to continue your appeal of the I485.

When you had the job interview with company B:

1) Is there any requirement for company B if you want to use AC21?

2) Do you need tell company B that you need help from the company(e.g. employment verification letter) when you file the AC21 later?

3) Before you leave company A, what kind of things you should do or check with company A?

4) Do people normally hire a lawyer when filing AC21 or do it yourself?


Case 2:
Suppose I got I485 pending over 180 days sponsored by company A. Also, I applied EAD card which will expire on 08/30/2004. Meanwhile I am maintaining my H1B1 status sponsored by company A.

If I decide leave company A and take an offer from company B.
Now I decide to use AC21 for transferring job from company A and B.

1) If I company B can't sponse my H1B1 transfer, can I just use EAD card to work for company B while waiting for the final approval for the I485 before EAD expires?

2) If I start to work for company B using EAD card (applied when I was working for company A) and EAD expires before I got my I485 approval, can I renew my EAD card? In this case, do I need provide any information from company A and/or B?

3) Do I need ask company A to terminate my H1B1 sponsed by company A?

As long as you are qualified for AC21, go ahead and change your job if that's really what you want.

EVL is no big deal, any company can/should/will do it for you.

You can work using your EAD and renew without problem. Of course, if you can maintain H1b, that's safer. If not, EAD is also good.

One thing to keep in mind is that it is better to get your I140 approval notice from your sponsoring company before you switch job.
