Hi,

My I140 was approved almost 18 months ago and my I485 has been pending for almost 18 months. My employer (in Massachusetts)who filed for the GC went out of business last month.

I found a job (similar postion)at a different location(California).
Does this affect my process?
Does AC21 say anything about the location?
Does anybody has a similar case which was approved?

My lawyer adviced me to try finding a job at my current location (Mass) as it would keep things clean.

Any help is welcome.

Thank you,

---Good
Does this affect my process?
----no problem just update USCIS for address change
Does AC21 say anything about the location?
---NO
Does anybody has a similar case, which was approved?
--Many have or will have, no problem if new employer gives future permanent job offer letter and write the same skill as on approved LC

---- AC21 August Memo does not say anything about future job location
Take the print out and Read the AC21 august Memo:

AC-21 has no restriction on location, finding "same or similar" job is the key.

------- If join new employer with H1 transfer then the job may or may not be similar it does not matter it is the FUTURE permanent job offer that should be same/similar, GC is based on future job Offer.

my lawyer said the same thing.
the cons of diff location job change are,
1) make the EAD AP extension more complex
2) chance to lose the case files during the tranfer from
one center to the other

yager,
both are not true. Sometimes in spite of location change- the case does not get transferred. Case files sometimes get misplaced anyhow- even without transfer. EAD and AP- should have no impact.
You can only take so many precautions. Lost of people are succcessfully and happily doing location changes.

what I said is "chance to lose...". everyone knows that many
got approval with any problem after job change. there may be a chance for losing the file and make the process longer because of possible transfer. the only thing is whether you want take the "low" risk.

my laywer suggested not to file AC21 but till you get the REF. following this approach, the case could be approved
without REF (just as you said).
