Hello,

Iam on my 6th year of H1B. My Labor priority date is Aug 2004(EB2-labor pending in backlog). If I change my H1B at this point, can i do my 7th year extention. In talking to my friends, following is what i understood:

option 1: if my current company agrees to continue my green card processing, then i can do my 7th year extension with the new company(claiming the labor with old company, which is 365 days old).

Option 2: Since i still have 11 months of H1B, I can change company and start new perm process with the new company which should clear in less than 4/5 months. Then i should be able to apply for 7th year extension. (Risky). I know i might loose the priority date in this case.

Please clarify whether my above findings are correct/wrong.

Thanks in advance

Option 1 is OK. 2 you may not qualify.
