I am in the same boat as well, my w2's for the last year are less than the latest LCA..infact my last year LCA's as well
Here is my situation
1. I was with Company A was laid off feb'02
2. found another employer B and filed H1 within a month (3/28/02)
3. H1 transfer took 5 months - approved on (8/28/02)
5. Started getting paid from Oct'02
6. Left Company B for GC purposes in 06/03
7. Now with Employer C getting paid continuously

I need to get my H1 and my wife's H4 stamped as they are expired 2 yrs ago my options are canada or Chennai (my wife is already in India)..

Now Is this going to be a problem if they question my w2's for the last year as they are abt 70% of current LCA .?
What is the best answer i can give them for last yr w2 with company B (H1 transfer took long time or on leave etc..?)

Even if i get stamped in canada my wife has to anyway get it stamped in chennai, India is it worth, me attempting H1 stamping in Canada..?

Please advice based on your experience..

Anyone came out of this situation...without issues..?

Hi Sushil27,

According to attorney's the violation is from the company and not a personal violation from the applicant ? Has anybody thought about it at all ?

What do you mean by the above? So if my current H1 Visa is denied, (In the meantime I have extended my H1 visa with the same employer and got approved). So can I get another H1B from other employer?

Please advise me!!!
 
Successful H-4 stamping - Chennai consulate

Hi,

This website helped us a lot. We want to share our own experience. Today my wife got her H-4 visa in Chennai consulate. Her appointment was at 9 am, she came outside by 10 am. She was asked some basic questions like when did u get married, where is your husband's place of work in US.

I had LCA W-2 difference in year 2002. So even though we got married in OCT 2003, because my job was more stable in 2003, we waited until FEB 2004 to attend with 2003 W-2. This may or may not have helped us. So please act accordingly.

Also, my wife was not asked anything about previous W-2's.

My wife submitted the following docs.

1. Complete H1-B petition including I-129 and LCA - certified by attorney
2. Current employment letter
3. Company brochures
4. Copy of offer letter
5. Copies of 13 months paystubs (entire 2003 + JAN 2004)
6. Copies of 6 months bank statements (with $13K of recent balance)
7. Copy of 2003 W-2 (my LCA is for $60K, my 2003 W-2 earnings $59K)
8. Copy of I-797 (H1-B approval notice)
9. Copy of my passport (all pages)
10. Copies of 6 months US telephone bills
11. Copies of 6 months US rent payment slips
12. Original marriage certificate
13. Marriage photos
14. Marriage invitation
15. My wife's passport
16. Visa application form(s)
17. Photograph(s)
18. Fees

I have a question along similar lines

I have a 20 days gap from the h1 approval date (march 10th '03) & my start date at work Apr 2nd 2003.(IT consulting)?

Before h1 I was on opt. OPT expired and I got h1 after about 25 days.

When going for stamping at chennai, What sort of a reason can one give for this gap of 20 days.
This 20 days pay shows up as a shortage in the w-2 total wages for 03 when compared with the throretical 9 mo wages.

Also based on my h1 start date of Mar 10th '03, till the end of the yr 2003. How many pay stubs will the expect.

What the best reason to give when one has had a bench period for like a month, esp those in consulting.
