Hello!
I was working with a company A on a H1B (valid till 2005). Then I transferred it to a company B in Jan 2003. I got the approval and new visa from INS Back. I am currently on Payroll of Company B.

Company B would be laying me off now. Can I go back to company A and start working for A, without transferring my H1 back to them? Is my previous visa still valid? Can I start working for them again smoothly?. Or do I have to file a new H1 with INS from Company A again?

Please advise.
Thanks,
Srikanth.

If company A has not withdrawn your H1 petition you can start working with them again immediately PROVIDED your job and salary are exactly same as before.
