My prev Employer file my i-485 in Jan 02 in VA .

TheY laid me off in Apr 02 becauce they could not find any project. They said they will not revoke the GC process .

I was jobless till Aug 02 .Found with a small comapny in VA but with less pay I joined them using EAD .They too laid me off in OCT 02 because of economy .

Luckily I managed to get project in Chicago and I relocated to Chicago using my EAD (Exprring in MAR 03)

My Prev companys lawyer says we have to send a letter for the address change and he says the case might get transferred to NSC .(where the processing is really slow compared to VSC)

I used AR11 to inform the address change and also called INS, Vermont to inform my new address in Chicago.

Asked INS, Vermont IIO if I need to inform them of my new employer they said if need come tey would ask for it.

Could you tell me the issues I may have with my GC can I still pursue it or is it better to ask my current employer to file H1 for me to be safe .

Is AC21 applicable at all to my case or is 485 not worth thinking of???

Appreciate your comments ASAP

Ac21 is definitely applciable in your case. After going through your Labor application, approval and I140 approval, ask your current employer to prepare a letter which offers same or similar employment as quoted in LC approval
The job should have same or similar responsibilities as quoted in LC application.

Most probably you will get a RFE, respond to this RFE with the recent paystubs and this letter. (Because you "spilled the beans" to IIO, you are likely to get a RFE)

If you get a local transfer, go with this letter and paystubs to the interview at the local INS office.

Thanks Jaxen

Any Idea how long it would take for me to know if the case is transferred to NSC??

I am currently earning about 10k less than in my LC is that a probelm again???
