Hi,

I have been in the US on a J1 visa, since 05/2002. I am a graduate student. My visa stamp expired on 12/2002 and since then I have been given extensions (IAP-66 & DS-2019) by my university. I have the following two questions: 1) I was not subject to section 212e, at the time of my arrival to US. However, I am currently funded by a government agency (US National Institutes of Health). I would like to know if whether I am subject to the two year home residency requirement now, because of the government funding.
2) I am planning to visit India next week. If I am subject to the 2 yr HRR, would it jeopardize my re-entry to US, while coming back from India during Feb 2005. In other words, would it be difficult to have a new visa stamped, because of the 2 year HRR?

1) yes, you are a subject, and your DS-2019 should have a not about your governement funding on it. When you get a new visa, an immigration officer will most likely annotate on your DS-2019 that you are subject to 212(E)
2) no, it won't jeopardize your chances.
