Jaxen, Mill, all the other experts, please help AC21

I have interview after 2 weeks, I lost my job one month ago with company B. before that I changed jobs from company A to B because of lay off in A only 2 months after filing the I485. Company B is refusing to give me employment verification letter as of today, but they are giving me these options:

1- either they give me employment letter dated on middle of June. one day before I left. In this case if the immigration officer asks about pay stubs, I don't have recent ones.

2- they give me a letter of job offer with starting date that is say 2 weeks after the interview date. the company says that this is better since it explains that I don't have recent pay stubs.


Please advise me of the best option,

OR if you think there is more options please let me know.
 
Is the interview is asking for paystubs or proof of employment in the list of required docs?

The secong option seem to be a better option. However I strongly recommend that you take an immigration lawyer with you to the interview. A lawyer will be the only defense possible at the interview. Have a strategy worked out.

the list of documents does not include pay stubs. I already agreed with a lawyer to take the case, but the only thing he will defend is the fact that I left the first employer before 180 days. About this specific issue, this lawyer wants me to prove that I am employed and will be employed, but I can only prove one of them. I guess, you are right, since they are not asking for pay stubs then employment letter should work.

Usually i guess GC is for future work

so a letter for future employer might work better. But again the job has to be same or similar field and has to satisfy the AC21 requirement. I guess in the limited time that you have..make the best with what you can get.

Option 2 will be better. But it is better to have both 1 & 2.

AC21 may not apply to you as you switched job before 180 days expired. Make sure company A does not inform BCIS about layoff.

Meanwhile look for another job. If you have H years then do not worrry. You can start all over again.
