i am currently facing either renewing my H1 which will expire at the end of this year or changing back to F1 (i have the i20 for spring semester).
Our company put us unpaid beginning from Oct. they are still hiring me and even encourage me to renew the H1 and file the Labor Cert which has just finished advertising. The attorney has agreed to file it at the end of OCt or beginning of Nov. I don't want to give up the LC until i hear something from the labor dept, but without the pay stubs i don't feel safe.
I have following questions, gurus please help give me some advice:
1. Are copy of recent pay stubs important or necessary in changing H1 - F1 ? i ask the intl student services at school, they said not required. from what i read in this forum, i know they are necessary in doing H1 transfer.
2. If i file the change status (H1-F1) now, and then file the LC to state, will the status change application affect the LC? and how?
3. will my filing LC be found out by INS and reject my F1 application ?
4. Can a H1 holder take classes in school with the I20 ?
5. if the RIR LC appl gets trouble in state level, i will forget it. if it can make it to fed level, i know it takes another 3 months to know the final result. If i am lucky to have the RIR LC done, and at that time i am in F1, can i change back to H1 to use the LC and continue the rest of GC steps ?
I know there are too many 'if' here, i just want to find out all the options if i could before i act. I have only 3 yrs left for H1, that 's the reason i am thinking of changing to F1 instead of wasting it while waiting for RIR LC if it fails eventually.
