My husband's h1 is in transfer process. Meanwhile my kid is in india with a h4 visa until jan 2003 from previous employer. can she come here with that visa before the approval? we have not filed for the 539 alongwith the h1 transfer. we planned to file after she comes here ? to get her h4 stamped in indian counsulate, i think my husband's h1 visa stamp must be on his passport. But we cant send his p.p for revalidation to st.luois because his visa stamping has expired last oct 15th and by the time his approval comes it will be somewhere in nov 2nd or 3 rd week.
i think there is not enough time for premium processing for h1 and sending it to st.loius for revalidation. today is almost sept.30th.
what is the solution ? can she come on the existing visa ? any problems at POE ?
