Here is my situation:

- Started i485 for company A in Jan 2002.
- Contract ended with client and went on leave of absense in May. Got EAD/AP even before that.
- Got offer from company B, started H1 transfere, joined company B on H1 end of May.
- Now, by Jul 20th, my six months for i485 are over.
- I have still some left-over salary/vacations with company A, as they are not aware of my job with company B.

My questions are:
1. Should I get my last salary from company A on old H1 with that company? Or should I file a new W-9 and go on EAD before I get this last salary?

2. Can this last salary be helpful for my i485 application in future (showing 6 months with company A), if required?

3. What approach will be best to get this salary in my current situation? a) salary on H1 (old W-9) b) salary on EAD (new EAD)?

4. Or should I just foget this salary al-togther?

Please guide.

I think the paystub /salary outlook is from your h1 days.
Anyway if you want to show that you were with company A, just the sixth month salary is not enough, you should have received all the previous salaries.

Since you did a h1 transfer, you have already violated the sacred 6 months wait before transferring to another employer. Dont you think INS will have this info in their file?!?

See the discussion about the issue of leaving (or not joining) sponsoring employer before 6 months from 485 RD..

I entirely agree with the outcome of the discussion. Right now find a lawyer who will take AC21 "aggressively" and will ensure an arguement if you face enquiry because of this. That is your only option.

Get an employment offer letter (after GC ) from new employer in order to vend off any Employment RFE
