my h4 expired 11 months ago, having h1 but not working. I need to know, if i leave u.s now, and apply for a h4 visa at madras counsalate in india, in the ds156 form we have a ? asking 'have u been in an unlawful status in the u.s' - this ? is a paranoid. either answers can be a problem.

what r the chances of getting a h4 visa at madras counselate ? how risky is this ? husband and kids will be here and i may be stuck there if visa stamping is a problem. this is a nightmare to me.i heard that madras embassy is giving a tough time for visa stamping. has anyone gone for a h4 stamping after overstaying here ? pls help me

Getting the H4 under this circumstances is a big risk. File for H1 to h4 change of status if you realyy want to do a safe protection of status.
Many such H4 holders (who have done a change of status to H1) have moved out of country only after crossing the 485/AP stage...

You have to evaluate the risk yourself and act. There are no generic rules of thumb in such similar circumstance. What can work for you may not work for others...
