My H1b expired and wanted to get EAD ASAP.

If I applied on December 24, 2001 (RD on EAD receipt), when should I eligible to get it iEAD? On March 24 or 25th?

What happens if I go on 24th or earlier? Is the IIO going to ask me to come back after 24th? or going to issue iEAD?

Can I eligible to fill 765 application myself when I go to INS office for iEAD? Or Should my lawyer only need to fill that form?

Depends on District office...

If you are travelling from a far off place to the district office, the information officer might look at your case kindly. Finally you will never know unless you try.
You don\'t need any lawyer for EAD.

Thanks jaxen... San Jose is my local INS office

I have a question on filling 765 application

Question 11:

Have you ever before applied for EAD from INS?
Yes or No
Which INS Office? Dates?
Results (Granted or Denied)

Should I answer the following

applied for EAD --> "Yes"
Office --> California Service Center
Date --> Dec 24, 2001 (Receipt Date or Mail date??)
Results --> Don’t know the right word? (should I mention “Pending for review”)

Question 15:
Current Immigration Status:
My H1-B is going to expire a day before I visit INS for getting EAD, so should I say “Adjustee” as my status.

possible answers...

Q11: Give the RD, and say pending

Q15 : Yeah adjustment applicant is ok. H1 will also be a technically valid answer in your case.

Thanks Jaxen for your valuable answers….

I shall apply for iEAD and let you know the results.

A small question:
When my H1-B is only valid until the day before I visit INS for iEAD, how come I can say H-1 as my status? Did I miss something?

I thought that it was the day after...

You should go to get EAD before expiry of H1, so that your employment is uninterrupted ...
