Hi All,
I have mailed I-140/I-485/EAD/AP all at once for me and my wife on Dec 20th 2002 and till now I haven't received my I-485 receipt, FP notice and my wife's Advance Parole receipt.

I was getting concerned and I checked the Online status and it says that My application for I-485 was rejected as improperly filed and was mailed back for correction. The specific reasons are explained in detail on the rejection notice mailed with the case. You can refile this case, after you have corrected the problems.

My lawyer has received all other receipts ( my wifes I-485 receipt and FP notice, EAD receipts of both, my AP recipt and my I-140 receipt ) and he has not received the my I-485 application back.

I would like to know that, once we correct the problems which INS has mentioned and re-submit the application,

1. Will my Receipt and Notice date will change ? Rightnow, my receipt date is 12/24/2002 and Notice Date is 01/27/2003.

2. If my I-485 application is rejected, how come INS has cashed my Check for $255( Towards Processing Fees) ? My check was cashed on 12/31/02.

3. Since they have sent back my I-485 application, what happens to my EAD and AP applications ? Will they will be in Hold status or what ?

While your case is strange, I won't be too concerned as it has happened in the initial stages - maybe you are missing docs such as I693. INS is known to return your package if the medicals are missing, though they haven't been consistent. Mostly likely you can refile after taking care the error. Regarding fees, maybe you can petition.

I have signed all my forms properly and I have checked them twice too. Like Frodo said, may be my lawyer might have missed some docs, I have yet to receive my file back from INS. Its been almost one month now and I haven't received anything yet.

INS has issued me a EAC number too and I am not sure how they will treat my case. I am actually planning to call INS and find out about my case.

Either you or your attorney should talk to an IIO asap and find out what exactly the status is for your I-485 application. As others speculated, the reason could be any of the following..

1. Some important supporting documentation may be missing.
2. Initially the data entry operator thought that some thing missing but later on when it went into review some one else thought that one can send RFE in later stages and just do the data entry for time being. It does happens some times that initially they want to send RFE (and the system is updated accordingly) but later on they just take it back after some review. In current case it is not RFE but some thing similar.
3. It could be just a wrong message on Online/AVM system but every thing may be just fine.

I have talked to IIO and found that my I-485 case is properly filled and she didn't see any issue and she told me that the Online/AVM system is just showing a wrong message and she also said that she has seen this kind of things happening frequently from last year onwards.

When I asked her why my receipt was not mailed, she had no proper answer and she told me that she will send me a duplicate receipt and she is going to show my case as an example to her supervisor.

Hi there,
I have paid all my processing fees and I gave my personnal checks for INS fees towards all my applications ( I-485/EAD/AP). Once they get enchased by INS, you will find the EAC numbers of respective application on behind of each check.

You will need to ask your Bank to give you a copy of the check though.
