Dear friends:

I filed I-140 in April 2002 and got approved in Oct 2002 (EB1). I filed concurrent I-485 in Sep 2002. Both I-485 and approved I-140 have passed 180 days well. I am working at a university as a researcher. Recently, I got an offer from a start-up company (founded in 2002) with same job title, duty, and much higher salary. I filed I-485 at NSC and the new company is at New York. I am holding H1B and the company will sponsor me for H1B. I do not know if I accept this offer. I need your suggestions?

If I accept the offer, could I file Labor certification after I go to the company when my I-485 is pending?

Since the jobs are similar and I140 has been approved, you can exercise AC21 and smoothly go to this new job. Consult a lawyer and prepare for all sorts of contingencies...

You dont have to file for a new LC...
