Jan and feb cases are bing proceessed

just wanted to share this with all of you though may be many might have seen it before.

I was browsing immigrationwatch.com and went to recent approval section where they have list of 149 cases approved by VSC in march.

I was more then surprised to see that out of 149 latest i-140 cases they have approved,more then 70 cases are from Jan and Feb 2004 few from nov,dec and september and vary few from july.

but def they are working on most of Jan and FEB 2004 case.

I would request anyone else to go and check that out and confirm my though,I hope it is wrong because it it is not then this is so bios.

seems policy has changed...

It appears VSC has changed I140 approval strategy. If you have noticed, for I140 filings after November 2003 the preliminary evaluation of I140 filing is more comprehensive. If paper work doesn't satisfy they are issuing RFEs within 3 weeks. This is resulting in quicker I140 approvals either way, with or without an RFE.

One of our company's I140 was filed on Feb 12, 2004. It got an RFE issued for company's ability to pay on March 3, 2004. If this policy was in place in early 2003 everyone would have been better off. I will be getting the same RFE after waiting for one year.

It is all about timing, circumstances and individual luck.

We all know that there has been a lot of approvals from Mar-Apr-May during the last two weeks. That site do not seem to list those info.

There are several more reasons for me to come to the above conclusion:
The numbers reported in that site are far too less to be believed. If you look at their historical reports, they reported about 65K I130 cases last year. As per INS stats, their are about 660K I130 cases per year i.e. ten times. Similar results wil come for other cases too.

Where do they get their info? - it is impossible for them to scan all pending cases. They will need 6M/200=30,000 ip addresses. INS certainly do not publish such info.

Lastly, has anybody any idea who they are?
 
Remember, it is very likely that most of these 70-odd cases from Jan/Feb 2004 are Nurses and Multi-national executives (the USCIS processing dates for these are around Jan/Feb 2004). I havent checked out the details of cases processed at immigrationwatch.com myself...does it mention the category of the cases approved?
 
Also,
i was talking to a friend of my friend he said that his company has filed 3,4 i-140 cases in year 2004 and surprisingly all of them have been touched,either approved or rfe is issued.

this is so frustrating.
 
Really? manoj2003 - post details. It is not impossible but not likely to be termed as possible.

As per my lawyer they have sent my 140 & 485 application to Vermont INS office on 26th Feb, The Fed Ex tracker says they have received the application on 27th march, But as of 29th march my lawyer says he hasnt received EAC#'s, Is that possible ?

As per the various threads in this forum most of the applicants receive EAC#s in 10 days. I am a bit tensed ...

Please Advice.....

Sometimes it takes upto 6 weeks - however that is really very uncommon - try to find from your lawyer if they have recd your receipt notice(s). You should have got it by now.

As I said the processing policy has changed post December 2003. A thorough preliminary check of I140 for issuing EAD/AP is resulting in quick approvals.

Atleast some one is happy.
 
only thing i can say is that this is tooooooo bad and this is not fair.

my attorney kept telling me right from july that this rule was there in place,he never told me that this tule would be implemented from january.

this is really frustrating and sick.

My case was filled around DEC 5 2003.. i did not get any RFE or EAD.. what does this mean.. my case is ok there is nothing found to issue RFE???

There is no rule regarding preliminary I140 processing. I think some sense has been knocked into their heads when they started issuing too many RFEs on company financials while processing 2ndEADs/2nd APS. Atleast people who filed after december 2003 are beneficiaries of fast I140 approval.

One of my colleague waited for 14 months to get I140 denial. If they had done what they are doing now, he would have known the result couple of months after filing.

Manoj I understand your frustration, but yours is nothing compared to my friend's situation because he has to leave soon since he is on 7th year extension.

Do you think with this new policy my I-140 will be touched during EAD/AP approval (which I filed in Jan 2004). My I-140/485 were filed in Oct 2003.

Did you apply for EAD also at the same time? Before issuing EAD they would look at I140 for sure. You have to wait and see whether it will be an RFE or an approval of EAD.
