Has any one heard of the J2 spouse and children successfully getting EB1 I-485 approval without the J1 spouse getting his waiver? I entered USA 10 years ago as J2 worked with EAD for 7 years. Then I and my spouse converted to O1. At my lawyer's advice, I applied for I-485 (EB1). My spouse got the J1 waiver after 18 months of my I-485 application.
