J1R to H1 for Physicians- Need help

I am a researcher on a J1 R visa (Physician from India)

On J1 R i was not allowed to see patients and was mentioned on the IAP66 no direct patient contact

I just received my waiver on basis of No Objection

My Boss is willing to sponsor a H1 visa

I want to start Patient Care if possible and also continue my research

Was wondering that when i fill my JOB description can i put Research, Teaching and Patient care

My question is by putting patient care i might reduce my chances of getting an H1
as i am changing my job description and adding patient care to research

H1 visa is being done by the University

hi,
If you have not done 3 yrars of residency in the US you cannot be involved in direct patient care.
You have to get state medical licensure too.

I have a training license but that is not the point

I wanted to know that by putting clincal in Job discription will hamper my chances of getting a H1 as initially i entered USA as a Researcher with no direct patient contact
 
This seems to be a sticky point. In order to qualify for H-1 as a physician (for patient care) you must have certified by ECFMG and have passed USMLE Step 3. To do research you don't need all of that. Therefore, there is a possibility of H-1 application denial if patient care is mentioned.

Consult immigration attorney.

That is not a problem and the job description will be of research

So can i get through with this
