Hi ,

I am currently on a H1 visa Working in an underserved area for my J1 waiver. I have been working for about 1 year. I have applied for my NIW petition already. I am about to apply for my PERM/ labour certification Petition as well..but I am getting married to an American Citizen..

Could you please let me know whether I should go ahead with my PERM process as well or it will not be needed..especially if I want to be done working in this area after 3 yrs. Any input will be appreciated..thanks

It is your personal decision... technically you can leave after 3 year... your American spouse and get GC probably in 6 months or so. For that 6 months period you'll be on H1 and you can transfer H1 to a new position which may or may not be in under served area.
