J1-waiver -how long it takes after state recommended the case

My case for J1-waiver (CONRAD 30) has been recommended by the state, Can any one tell me how much time does it take from here and what are the next steps?

I can only tell you my experience. My waiver was recommended by the DOS on Nov. 3rd 2004 and received by the USCIS on Nov. 13th. Initially, the USCIS will send you a letter stating that your application for waiver has been received. The next notice you will receive from them would be the notice of approval (assuming they approve it). I got my approval on Dec. 6 (that is I-797). That same letter will then advise you that you can now have your employer file for an H1B chnage of status in your behalf. After your employer has filed for it, the next thing that you should be expecting is notice of approval of H1B (I-129). I got my approval on January 28.You can check you status on-line though the USCIS website through your receipt number. I hope this helps.

Thank you for the reply. How much time does the DOS take for the approval , I beleive my application is recommended by the new mexico state and been sent to DOS-DC last week. Also what is the I797? I tired to check on the web.could not find it.

You're welcome. I don't know exactly how long DOS grants the recommendation after they receive the letter from the state. In my case, my employer applied for my waiver through Conrad 30 on the first week of October and the next notice I got dated Nov. 3rd was from the DOS saying "the Department has reviewed the request and finds it in the Public interest and recommend to the USCIS that the waiver be granted to the exchange visitor..." You see, I did not know when the state of California sent my recommendation to the DOS.

By the way, why is it that you don't seem to be sure which state the letter came from? It should be where you will be working. So are you going to work in New Mexico?

I-797 is the form (notice of action) which the USCIS sends to inform applicants that their waiver request has been received and then later that the waiver has been approved.
