Hi,
I have been in the US for the last 6 years came here on F1 to do my Masters, completed my studies using my own personal funds, Worked for a Hotel on my OPT. when my OPT expired, went back to my home country for a month they got me back on an J1 VISA but when the visa was issued it had the 2 year HRR rule saying "management trainee - specialty skill based".

I married my long time sweetheart and his 485 approval is pending. I need to get my waiver done before I could be added as a spouse to the 485 application. I am preparing my letter of statement to apply for waiver. my reasoning will be that I have received absolutely NO funds from my home govt or US govt. Would it be detrimental to include my marriage and cite that as a secondary reason for waiver? Any advice would be very welcome.

Another question : Is the salary for the term of my employment on J1 VISA counted as funds for my management trainee program?

Thanks

if your HRR is skills based and you manage to get a no-objection letter, you have a pretty good chance of getting the waiver. Hurry up though, coz it takes anywhere from 4 months to a year (depending on your security check, your country's consulate, your sponsor reviews, etc). Check out a yahoo group devoted to HRR as well.

Your reasoning in the statement should also include the benefit to the US if you get to stay.
