J1 to IR1 AND J1 to K3

Hi Frans...

I would like to take your help for below case.

- I am an Indian citizen and was there in USA on J1 visa ( Dec 2005 to June 2007)
- I am subject to 212 (E) clause.
- Currenlty I am in India.
- I just got married to US Citizen girl. She is india since last one month and flying back to USA in March 2008.
- We are preparing immigration file for me.
- Do my previous visa ( J1) make in impact on this IR1 visa? If yes then what is the procedure to avoid any impact ?

Is it possible for me to go for K3/K4 visa ? Again any impact of J1 here.

If you are subject to 2 YHRR you are not eligible for any immigraion visas including a K-visa. You will need to apply for a waiver before you can procced with your immigration. You may apply for other non-immigrant visas, though.

Now what would be the best approach to get waiver...I mean ( NOC or external hardship etc...)

Also can I go ahead ans apply petition for Immigrant visa and parallely the waiver process ?
