J1 to H1 :)) Status change..!

Hi,
I am wondering if any one crossed this phase..please post your experiece to this forum and it would be very helpful to us.

At the present situation, I have recevied a favourable letter from DOS. Can i apply for H1 visa ie to change my visa status from J1 to H1 ? DOS website says that i cannot extend my J1 visa once if i get a letter from DOS that means can I change for another non-immigrant visa..like H1....??

I found one article in this forum stating that...one can apply for H1b once we receive the letter from DOS..and INS may approve with the condition of FINAL Waiver from INS. INS will allow us 90 days to submit the FINAL waiver...!

Please post a reply..if some has a information about this phase..! My J1 visa will expire soon and i need to change my Visa status to H1B.

yes, I have a similar experience. I applied for AOS as soon as I got my favorable recommendation (no objection waiver). I submitted a copy of it with the AOS. A week later i got a notice of receipt for the form I-612 that INS automatically issues when DOS forwards the case to them.

the rule is that (in no objection and IGA cases, but not in hardship or persecution cases) -- you can file AOS (or application for H1) concurrently with the filing of the waiver (in these cases waiver filing happens without your participation). that is, as soon as you get a favorable recommendation - consider your waiver filed at the district center.

here is my timeline:

DoS get my complete file at the end of May (no objection). A week later it issues a favorable recommendation letter (online status, June 7). Three weeks later I get the actual copy of the favorable recommendation (June 25) and file for AOS. The waiver file is received by TSC on July 1, and they send me the notice of receipt. My waiver was approved by TSC on 12 July. On July 15 I had an approval notice in my hand.
 
Did you file for I612 and H1B simultaneously

My Lawyer has concurrently filed for H1B and Final waiver (Waiver file received by NSC on July 16).

The online status says h1b has been approved, but the I612 (waiver) still says application received.

My question: did you file for h1b and I612 together and were they approved simultaneously?
