j1 to H1-B

Hi guys,

I am an Australian Citizen currently on j-1 visa and stamped as duration of stay. My visa expires on 31-March-2005. I am not subject to the 2 year home residency rule. I want to apply for H1-B in april 2005.

One attorney said that once my visa expires i should go back to australia and only after 1 year can come back to apply for h1.

Can i apply for H1-B in april 2005?

hey,
if your current VISA say that the two year does not valied, then can always apply for a conversion. but only thing is that you need a waiver/advisory opinion whatsoever your J1 visa says,
