J1 --- H1----gc
Hi Folks,
Well just correcting my post as I referred to the previous posts and was enlightened.
Few qtns still remain unanswered !
I understand that once you find ur J1 waiver employer you file for j1 waiver approval at the USCIS ( do we also have to file along with J1 waiver petition a seperate H1B petition )and once approved start the job on H1B. Correct ? Minimum of 3 years is needed to work on J1 waiver ( on H1B status ) BEFORE one can start working on GC process . Is this right ?
Also
1 - In case of H1B reset timer one has to be physically outside the US for 365 days.
Does that mean one cannot enter the US in this time on a B1/B2 or F1 or H4 visa also?
If I decide to stay outside the US for 365 days and enter to reset my h1B timer ... can I file my 'new" H1B petition before or within the 365 days or have to wait till 365 days are complete and then start the 'New" H1B filing process ?
I refered to HADRON's previous posts and he mentioned " I know people who did something else: They went back after residency, worked as junior attendings in india and then came back for their fellowships either on H1b or on a green-card sponsored by a prospective employer."
Is it prefered to go this way rather than J1 waiver ?
BECAUSE IN MY CASE I HAVE ALREADY EXHAUSTED 3 YEARS OF MY 6 YEAR LIMIT ON H1B BEFORE MY 3 YEARS IM RESIDENCY.I CAN TRY TO GET SOME TIME SPENT OUTSIDE DURING THESE 6 YEARS BY APPLYING FOR 'H1B TIME RECAPTURE' BUT I CAN USE THESE MONTHS TO FIND SPONSOR FOR MY NEW H1B VISA WHILE I AM PHYSICALLY OUTSIDE THE US AND NOT TO START GC PROCESS FOLLOWING RESIDENCY.
