I formerly had a J1 visa with 2 year home residency requirement.

After I finished my Master's, I went back to my country and changed the Visa status from J1 to F1 before I started my (current) PhD.

My question is if I am having J1 before and F1 right now, can I apply for an H1B visa ?

Thanks a lot for your help

If you stayed in India for 2 years after J1, there should be no problems, else you would need a no onjection certificate from India.

Yes, you can absolutely adjust your status from an F-1 student status to an H-1B visa. The first thing you would need to do is find an employer, then your employer would need to file the H-1 petition for you.

The employer will need to do a prevailing wage determination to make sure that the wages they will pay you will equate to the same wages paid by anyone else in the particular county where you will be working in the same occupation.

Then, this will need to be filed with the Department of Labor. Once this step is completed, you will need to file the H-1 petition, which will include the Labor Conddition Application.

The H-1B visa alottment is currently available 10/01/06, and you can apply as early as 6 mos previous to that date, so now is the time to file.

If you need help petitioning Citizenship and Immigration Services for your H-1B, I am an Immigration Specialist with many years experience filing H-1B visa petitions. I currently file many petitions weekly, and am in constant contact with CIS Officers, to keep up on the ever-changing rules and regulations. All H-1B petitions, effective 4/1/06, are to be filed with the Vermont Service Center, with California and Vermont pairing up to process all H petitions.

Please do not hesitate to contact me if I can help you file for your H-1B petition. I am based out of Tulsa, Oklahoma, and you can contact me at immigration_now@hotmail.com, or feel free to call me if you have questions at 918-724-9252.
