ques for ma friends

1.Can ppl apply for H1B if they are out of status?
2.Can ppl on J1 apply for waiver if out of status? What if they marry a us citizen,(bearing in mind they were out of status) get the Employment authorization card (which puts them back in status and apply for waiver). what are the chances for denial based no objection

2) how do you expect them to get an EAD, if they can't apply for adjustment of status until they get a waiver? IN my case, DOS required proof of my legal status before they issued a waiver.
