My girlfriend came here on a J-1 visa to work at an Au Pair service. She ended up leaving the program and working illegally, and still is currently (February 2011). As written on her visa it expired on October 2010. After we get married she wants to visit home for at least 4 weeks asap and be back in time to go to school in August.
1) I am assuming her visa expired when she left the program correct? (as opposed to it lasting until the date stamped)
2) Will the I-131 advanced parole be approved since she was here on expired visa for more than 180 days? and if approved if she has been here illegally for more than 180 days will she even be allowed back in the country or be bared entry for 3 years?
