I joined this forum , OCt 2004 and my NIW case was in horrible state
even my Lawyer"sheelaM" said if is hopeless case.
but u have reasoned it out so nicely and gave me confidence, which I wll never forget in my life time!!!!!!!!
u rearranged my case chronologically and I followed and I got approved and few days ago, I got my passport stamped!!!!!!!!!

can u give me some tips , i want to open my own practice after 3 years in medically underserved area.
1.do u notify the DOH about where u are opening the practice
2. did u do solo / PC / what kind of practice
3. any other useful tips
 
hi, lalala: here it is what i did about my practice

1.do u notify the DOH about where u are opening the practice
As NIW physician, they seems to be not interested what we do after 3 yrs of contact. DOH was fine with me , when I personally visited them and showed what I did.

2. did u do solo / PC / what kind of practice
I did Solo for 1 and 1/2yr of my last 2 yrs, then I did PC for some reason, but u will end up paying more taxes with PC , so becareful. Talk to your state accountant.

3. any other useful tips:
keep all documents of your practice: telephone bills, rental bills, advertisement bills, electric and heating bills and any official info from any state health related issues, sign in and sign our sheets(clinic 40hrs/wk), any communication with patients(remember: HIPPA and JCAHO regulations), keep records of your holidays and vacations, sick leaves. try to get letters from your sponsor about each year of completion( it was useful to me , as he bacame bankrupt, I already had 3 yrs of letters from him and finally he refused to give any letter to me), u can practice in the same location with your new PC or Solo practice, or u can put up practice in same location but in same street or different( I did move my practice location to different street, but same HPSA area), get some communication letter with commisioner of town(I had a lettter about asking him to include in Town's web site)

mine is HPSA based on low income/migrant population , so i was wondering if i can open up clinic in different area as long as i show that i am seeing low income and migrant population
its is going to be hard ( even though the plus point is that pts know me by now) but staying in the same area and seeing pts which can be seen otherwise in the CHC for $15 only will not generate any revenue

Congratulations on the certification.
I think that opening a practice in an area which you are already familiar with and patients know you is a big plus. Do you have a non compete? Also another thing is that on NIW you can finish the 5 yr requirement in 6 yrs. Which means that after finishing 3 you can take a break for a year if you want...

well thats true , although its a very small place with a limited population and i woudl have to compete with the CHC where i work ( where if u have no insurance or u are illgeally in US u can be seen and get everthing done for only $15 ), so i will be barely able to pay for my overhead and malpractice ( might even incur some annual loss)

In most states, J1 waiver jobs are not allowed to have non-competes. The idea is to motivate the J1 doc to stay in the area afterwards.
 
i do not have a non compete clause on my J1.
can u clarify about taking a break for one year ( does it mean do job anywhere, open or practice in any area and if so use what visa, i have approved 140 and H1 visa but as is universally said i dont want to use my 140 and keep H1 visa current
 
does yr HPSA area has hospital where u can do night calls

if there is hospital in HPSA area one can do extra hrs work without any risk. That is what some people did. Or your sponsor can get his practice on your behalf an affilation to that hospital and u can work and divert extra hrs work pay into that (Sponsors)W2. are u sponsored ? Group Practice?
Even on J-1 visa while doing residency , one is allowed to do extra hrs work in the same hospital where ur was doing residency/fellowship.
