J-1 to H-1 on Jan 10, 2000? when is my 5 years?completed

my paralegal thinks that it is Jan 9, 2006
I told her that it will be Jan 9, 2005
please clarify and also should I send compliance report before (few months) completion of 5 years. If so what is format of letter should be
please help me, my attorney seems overwhelmed by this facts!?

5 years counted the day u convert to ur H the day ur 1st H is approved so in ur case it will be jan 2005 and not 2006 just send a letter from IGA thats all they need

just to modify kidsdoc's statement:

5 years will be counted the day you start your (J1 waiver to) H1 job. e.g.

(a) H1 visa stamped from a US consulate on Jan 1, entered US on feb 1, started H1 job on Feb 10 >>> 5 years for NIW will be counted from Feb 10.

(b) H1 status change (means you didn't go out of US) requested from Feb 2, start actual job on Feb 15 >>> 5 years for NIW will be counted from Feb 15.

caveats:
H1 validity will be counted from Feb 1 in (a) and from Feb 2 in (b)
