Can anybody please give me a thought if I have a problem with my H-1B:
- Came to US on J-1 with 2-year HRR, completed program, came back to home country and got F-1 visa to return to the US.
- Completed the program on F-1. Not getting a waiver for the HRR, not fulfulling it either.
- Applied for H-1B through change of status (no visa stamp) and got approval.
On the I-129 (petition) filed by employer, there is the following question:
Is the beneficiary of this petition a J-1 nonimmigrant alien who received a waiver of the two-year foreign residency requirement described in section 214 (l)(1)(B) or (C) of the Act?
I was a J-1 but I did not receive the waiver. So I answered NO.
Is there anything wrong in my process? Will I have a problem later on if they find out about my HRR which were not fulfilled?
