J-1 to F-1 COS application

Hello,
I am currently on a J-1 Research Scholar status at a university in the U.S. My DS2019 specifies that I am not subject to the two year residency requirement, my skills set isnt a part of the EXchange Visitor Skill sets for my home country. I also didnt receive any direct NSF or U.S government funding. My employment was through the university and was classified under as administrative and technical staff for the university. I have been accepted to an MBA program and applied for a Change of Status from J-1 to F-1. In my statement of reason I did make a case about why I am not subject to the two year residency requirement and included the relevant documents (DS2019) which specify the same thing. At the same time I have applied for an advisory opinion to the DOS about this but havent included that information with my COS app.

My question is, will USCIS ask for waiver recommendation even though I am not subject to HRR? Or, am I just plain freaking out and thinking too much?

you will get an advisory opinion stating that you are not a subject. You didn't even have to ask for it.

Thanks for the reply! So is my case a pretty straightforward one and I should relax? I was told by my university people that I need to file an advisory opinion because the endorsement on the DS2019 "not subject to the two year requirement" is a preliminary endorsement. Does USCIS take the "not subject to HRR" on DS2019 and make a decision based on it without asking for further proof (i.e. advisory opinion)?

if you have no skills list, or govt financing, or medical studies - you are not a subject. They'll determine it from your DS-2019. Your case is fine.
