J-1 Status I-765 Form

My husband has a J-1 Visa and was granted the 2 year waiver. I'm filing out the I-765 form for him now, what eligibility category would it fall under since he's applying through marriage. Also, it says we have to submit a written statement? Can anyone please help me out?

Is he applying for a green card based on marriage to you, and are you a US citizen? A written statement is not needed for the I-765 if it's tied to a marriage-based I-485.
