it's me again...new question... NEED your help please..

I am 27 years old and I was petitioned by my mother as I-130 Child Over 21 that was filed on May2001 and up to now we have not received approval from USCIS. I am here in the US since 1994 but something went wrong with the adjustment of status before.

Anyway, to make it short, my mother is now eligible to apply for US Citizenship anytime. I do not know if her becoming a US Citizen will be good for my petition.

We are from the Philippines and my current category on NVC is F2B and the current priority date is Jan1994 (Philippines) but according to the immigration officer when my father asked them a few months ago when he was interviewed for naturalization, if my mother (principal sponsor) becomes a USC, my petition can just be upgraded and she can just apply for my adjustment of status. how true is this?

My BIGGEST worry is if she becomes USC, my NVC category will move to F1 and the priority date for the Philippines is only Oct1991. So does it mean that if she becomes USC, my case will become worse because the waiting period will be longer.

Please help me if you have any idea about this.... I need your knowledge while I can still stop my mom from becoming a USC for my sake... Thank you so much....

You're basically correct. Your mom shouldn't file a citizenship & upgrade your petition to F1 at this point.

Her becoming a citizen won't effect the I-130, unless she upgrades the case. Apparently, there is no point to upgrade it, since the priority date for F1 is more than 2 years older than for F2B.

That's not true! How can she apply for adjustment of your status if by upgrading your case you make your waiting period to be 2 years longer than it is now? :confused:

Like I said, she can become a citizen: that won't hurt your case. ;)

have you contacted the service center for your i-130? how are those dates? depending on the center, your petition will be approved much faster when it comes to the citizenship of your mother. and your pds are are soo far that your mother might as well upgrade the petition. see, is a two-process thing. some peopel get i-130 approval and then have to wait years for visa. or the visa is there.

Well, his visa is "not there" yet, since he is not considered to be an immediate relative of USC. And, based on current visa bulletin, the wait would be longer if the USC mom upgrades the case. Why would you say it would be faster?

I just want to make this clear. So my mom can become US Citizen without upgrading my case? Or can she just not notify NVC that she became USC? and if she won't notify, will this not be fraud?

My understanding is that it's her choice to upgrade her petition after she becomes a citizen.
Please correct me if I am wrong!
 
Yes, it is her choice, to upgrate your petition from F2B to F1 or leave it as it is. And dont worry it is not against the law. Good Luck!
