Yeah -- I'm starting to think that the 3-wave theory is alive and well (as it was at the I-140 stage).

The theory is that the VSC has a "leading" wave which is making a quick pass through all pending cases to see if there are any easy approvals. Don't ask me what an "easy" approval is -- maybe this depends on the country of origin and whether all the paperwork, FP, namecheck is in ready. This wave seems to be at around June - August 2003 NDs currently.

The next wave handles "typical" cases (those which require a bit more work but nothing exceptional) and this seems to be at around October - November 2002 NDs.

The final wave cleans up the difficult cases and might still be dealing with cases from early 2002 or even earlier.

Or, they could be randomizing the cases in a large rotating drum and pulling them out in whatever order...

one possibility could be the staff who joined VSC after more budget sactioned were assigned 2003+cases. I will not surprise if these same people touches late 2003/04 files in very near future otherwise there is no reason why 2002 cases are pending and aug/sep 2003 are being approved.

I am also trying to understand why FPs are not sent as per the date application receives the way 140 were approved. Murthy.com says USCIS has some policy not to send FP untill file is ready to adjudicate (which is true in most of the FP2 cases) whereas I read in this forum that FP is generated by computer system and depending on the workload at ASC. which is believable??

Another question comes to mind is whether USCIS thinks that the date it receives name check record for the petitioner is the 'actual' RD of I485? so Backlog of I485 at USCIS depends on the backlog of FP/Namecheck at FBI??

Looks like you are right. I verified rupnet now. I seen lot of approval till August 2003. Most of them are approved in August and this month. seen more approval in april 2003 to August 2003 with September 2004 approval date. Jan 2003 to mar 2003 approvals are approved between July to September 2004.

Your analysis make sense to me.
