It's a SAD situation, Please HELP!!!!

My cousin met her husband in 2004, he left Vietnam for U.S in 2006. He came back & married her in 2011 in Vietnam. 3 months ago (a yr later), he became a U.S citizen. They have a child together, the baby is now 6 month old and lives w/ the mom in Vietnam.

Her husband cheated on her, and now wanting to divorce her. He has not initiated any paperwork for her & the baby.

It's heart-breaking to see my cousin being treated like that. What can she do? What options does she have? Please help!!!

From my limited knowledge - it seems the child can acquire US citizenship (assuming his father was a US citizen). His dad has to be a little co-operative and your cousin will need to get citizenship certificate from the US embassy there. Checkout these links from US govt. site:

The wording of your post is kind of confusing.

From what I understand, your cousin is a Vietnamese female. She is married to US citizen and they have a child together. Since you are posting your post on this immigration forum, I don’t think you are seeking advice on repairing the relationship. So the conclusion that you want to find away to bring your cousin over to the US. All depends on the US citizen husband. If decides to divorce, case close. The child is six months old and the father is three months citizen, so the child must have been born while the father was on greencard in which case the child does not derive citizenship status automatically. In short, if the husband divorces, case close;
