ITIN to SSN

Hi,

My 485 and my wife's 485 are pending. we have EADs. My wife was on H4 before with ITIN.

Is she eligible to apply for SSN now? or do we have to wait for GC approval?

Hi sylvania,

Yes, she is eligible to get the SSN#. I got for my wife too. we went for finger prints and Local asked for her SSN# , I told him she has ITIN then he explained you have to get the SSN# as soon as posible.

she will be issued the SSN# stating valid for work authorization.

I just read somewhere, we can apply for SSN as soon as we(ITIN persons) get EAD.

yes, minors can also get ssn when the 485 is pending. the route i did was i applied for ead for my minor son, then showed the ead to get the ssn #. it worked in my case and i personally knew some of my friends who did like me to get ssn# for their minor children.

EAD will not be issued to any person below 16 years of age.

my son was 10 yrs old when i applied for his ead(nebraska in 2002), and my friend's kid was 8 yrs old (vermont 2001), so i think we can apply for our children's ead along with ours for ssn# purposes. this was in 2002 and i applied for my son's ssn# in early 2003. i dont know if any of the rules changed since then....

Is this a Mistake?

EAD means Employement Auth.. Doc... How can the USCIS issue an EAD to a child? If this is true this proves the inefficiency of the USCIS or they must've just done it for the money.

The EAD for a child will be not be of any use except maybe to get a SSN(as in this case). If the SSN office issues a SSN to a child based on the EAD then it shows the inefficency of the SSN office too.
 
Related question - does the primary applicant's soc security # needs to be changed after GC approval? Someone once told me that the way ur social security # is structured (starts with 6/7 etc), it is designed to let employers know that you need CIS authorization to work. However, for GC holders and citizens, it is structured differently (starts with 9 etc..), and is designed to let employers know that you do not need CIS authorization. Hence, once we get GC, we need to (should) get our soc sec # updated.

Is there any basis to this? At first I thought it was a bunch of bull.. but wanna know if any of u have heard of a similar story..

The SSN does not change after GC status.

As far as I know.... the SSN does not change if you change from a H1 visa to GC status. But you may want to inform the SSN administration to update your status from Visa to perm residence.

If you look at the SSN card you have now it would say ' VALID FOR WORK ONLY WITH INS AUTHORIZATION' . If you inform the SSN administration they will update your status and issue a new card with the same SSN but without the 'VALID FOR ...." statement in your SSN card. Search in the this forum and you will find more deatiled info about this.

I think BCIS will issue a EAD card to any person with I-485 pending when he/she applies for it. It does not matter whether they will work or not. Also the SSN office will issue a SSN # based on the EAD card for minors. SSN is not only used for working but also to pay taxes. What happens when we invest on the name of the child and he has to pay the taxes either on ITIN or SSN.

Also the kids who are born here will get an SSN within the 1st month of their birth itself.

I think, this is not the inefficiency of BCIS or SSN office whether to issue a EAD or SSN to the minors. I think it is relative that they need those for other governmental purposes like Taxes, etc.

These are just my thoughts and personal experiences with my friends...

The taxes can be payed for minors using ITIN. Same for investments.

I am not saying that issuing a SSN for minors is wrong but issuing SSN based on EAD doesn't make sense bcoz as far as I know the primary (and may be sole pupose) of the EAD is to allow the applicant to work and minors cannot work in this country.

The SSN has many purposes. A newborn child gets a SSN bcoz he/she is a citizen of USA. This falls under a separate category.

There is no need to cancel the ITIN, as far as I know. we never called BCIS or SSN office to cancel the ITIN

But you'll have to let IRS know, that you now have a SSN. I remember reading this either in the ITIN application form, or in the ITIN approval card. I suppose IRS cancels it.

ITIN is IRS' domain.

Yes. If you still have the letter coming with ITIN, you will see there is an address where you should wrote to after you get the SSN.

My son is 13 years old, he wrote some articles for
a newspaper, and then published, the editor ask his SSN to pay money to him, my i485 is pending, so it means I can apply a EAD and then SSN for my son ... ?

currently I just gave my SSN to editor (by the way I have applied EAD and SSN for my wife)

any input from you is very appreciated.
